1. IN THE SECTOR FOR DETERMINING RESTRICTED AGREEMENTS, ABUSE OF DOMINANT POSITION, MERGER ASSESSMENT, INDIVIDUAL EXEMPTIONS AND SECTORAL ANALYSIS, the following activities are performed:
monitoring and analyzing the conditions of competition in the market and the markets of certain defined economic sectors; determining the methods of competition research; making sectoral or internal analyzes by order or directly for the purpose of monitoring market changes, analyzing competitive conditions, market participants’ comments and service users; cooperation with regulators, competent bodies and organizations that supervise the execution of service activities in the territory of Montenegro, professional and other professional associations that regulate the conditions of performing certain activities, the Central Bank, the Insurance Supervisory Agency; CALIMS and FZOCG, working with competent bodies and organizations to ensure smooth market development, with the aim of analyzing the conditions of competition in the markets; preparing draft measures for participants and associations of participants for violations of competition or for their prevention, termination of breaches already made and elimination of harmful consequences per participant and consumer; the gathering of data relevant to the determination of facts in the procedure of competition protection and to this end, whenever necessary, direct insight into business premises, land or vehicles of a party or other participant in the proceedings; gathering data in order to determine the dominant position of individual market participants; gathering data in order to determine the relevant product and service market; the management of administrative procedures in the area of prohibited agreements, abuse of dominant position of certain market participants, concentration estimates, the exclusion of certain agreements from prohibitions and concentrations to prevent, restrict or distort competition or the free development of an open economy, in particular the creation or strengthening of a dominant position on the market; preparing requests for initiating misdemeanor proceedings for filing with the competent authority and / or issuing misdemeanor orders in accordance with the law governing the offense; preparing proposals for opinions on the application of regulations in the field of competition protection; preparing proposals for opinions in relation to the applicable regulations that affect or may affect competition; cooperation with international organizations, networks and institutions involved in the protection of competition; establishing and maintaining regional co-operation; preparation of reports, protocols, agreements, memoranda and international documents on cooperation with international institutions; monitoring regulations and applying EU practices in the field of competition protection; making reports on the work of the Agency from the scope of the Sector Affairs; monitoring of business policies, acts and actions that are or may be committed to violating competition; control of implementation of the measures imposed by the Agency’s decision; publishing statistical data, as well as performing other jobs in accordance with law.
1.1. The Department for the Determining Restricted Agreements deals with: preparation of proposals for resolving in the procedure and proposing measures against participants and associations of participants for violations of competition or for their prevention, termination of already incurred injuries and elimination of harmful consequences per participant and consumers from the scope of the Department’s work; gathering data that are important for determining the facts in the process of establishing prohibited agreements and conducting direct insight into business premises, land or vehicles of a party or other participant in the proceedings; conducting administrative proceedings in the area of prohibited agreements; preparing requests for initiating misdemeanor proceedings for filing with the competent authority and / or issuing misdemeanor orders in accordance with the law governing the offense; control of the implementation of the measures imposed by the Agency’s decision in the part of determining prohibited agreements; preparing proposals for opinions on the application of regulations in the field of competition protection; preparing proposals for opinions in relation to the applicable regulations that affect or may affect competition; establishment and maintenance of regional cooperation; making reports on the work of the Agency in the part of the Department; monitoring regulations and applying EU practices in the field of competition protection; and performing other jobs in accordance with the law.
1.2. The Department for Determining Abuse of Dominant Position deals with the following: preparation of proposals for resolving in the procedure and proposing measures against participants and associations of participants for violations of the competition or for their prevention, termination of already suffered violations and elimination of adverse consequences for participants and consumers from the scope of work of the Department; the collection of data relevant to the determination of the facts in the procedure of determining the abuse of dominant position and the conduct of direct insight into the business premises, land or vehicles of the party or other participant in the proceedings; conducting administrative proceedings in the area of abuse of dominant position based on established dominant position; preparing requests for initiating misdemeanor proceedings for filing with the competent authority and / or issuing misdemeanor orders in accordance with the law governing the offense; controlling the implementation of the measures ordered by the Agency in determining the abuse of dominant position; preparing proposals for opinions on the application of regulations in the field of competition protection; preparing proposals for opinions in relation to the applicable regulations that affect or may affect competition; establishing and maintaining regional co-operation; making reports on the work of the Agency in the part of the Department; monitoring regulations and applying EU practices in the field of competition protection; and performing other jobs in accordance with the law.

The Department for Merger Assessment and Individual Exemptions deals with: preparation of proposals for resolving in the procedure and proposing measures against participants and associations of participants for violations of competition or for their prevention, termination of already committed injuries and elimination of harmful consequences per participant and consumers from the scope of the Department’s affairs; gathering information relevant to the determination of facts in the procedure of protecting competition and conducting direct insight into business premises, land or vehicles of a party or other participant in the proceedings; conducting administrative proceedings in the area of concentration estimation, exempting certain prohibitions, concentrations preventing, limiting or distorting competition or the free development of an open economy, in particular creating or strengthening a dominant position on the market; preparing requests for initiating misdemeanor proceedings for filing with the competent authority and / or issuing misdemeanor orders in accordance with the law governing the offense; control of the implementation of the measures imposed by the Agency’s decision in the part relating to the assessment of concentrations and individual exemptions; preparing proposals for opinions on the application of regulations in the field of competition protection; preparing proposals for opinions in relation to the applicable regulations that affect or may affect competition; establishing and maintaining regional co-operation; making reports on the work of the Agency in the part of the Department; monitoring regulations and applying EU practices in the field of competition protection; and performing other jobs in accordance with the law.
1.4. The Department for Sectoral Analysis deals with: data collection, processing and analysis and sector or internal analysis, on orders or directly for the purpose of monitoring changes in markets; determining the methods of competition research; gathering data in order to determine the dominant position of certain market participants; gathering data in order to determine the relevant product and service market; collecting data with immediate insight relevant to the determination of facts in the process of protection of competition; analyzing acts and actions that are conducting or may violate the competition and proposing measures in the area of prohibited agreements, misuse of dominant position, concentration and individual exemptions; collection, cooperation with international organizations, networks and institutions in the field of competition; establishing and maintaining regional co-operation; monitoring of regulations and application of EU practices in the field of competition protection with the aim of making analyzes; monitoring and analyzing the conditions of competition in the market and the markets of particular economic sectors; cooperation with regulators, competent bodies and organizations that supervise the execution of service activities in the territory of Montenegro, professional and other professional associations that regulate the conditions of performing certain activities, the Central Bank, the Insurance Supervisory Agency; CALIMS and FZOCG; to maintain cooperation with the competent authorities and organizations in the plan to ensure undisturbed market development and to prevent competition constraints in the acts of these organs; making, reports on the work of the Agency in the Department’s part; monitoring the regulations and applying EU practices in the field of protection of competition and carrying out other activities in accordance with the law.
2. The STATE AID CONTROL SECTOR deals with: conducting administrative proceedings and solving individual administrative matters in the field of state aid; collecting, processing and monitoring data on planned state aid; control of compliance of notified state aid with the State Aid Control Act (previous control), assessment of State Aid Compliance, giving opinions on proposed acts that could potentially represent state aid, initiating a test procedure related to potential state aid, checking compliance of the State assistance and purposeful use of state aid granted under the State Aid Control Act (subsequent control); handling in cases of direct control of use of state aid granted, collection of data on use and effects of state aid granted; monitoring, realization and effects of state aid granted; ordering the repayment of unlawful and unequal state aid: preparing requests for initiating misdemeanor proceedings before the competent court and / or misdemeanor orders; giving the opinion at the request of the state administration body, the competent authority of the local self-government and the legal entity that manages and disposes of funds from public revenues and state property in accordance with the law in the preparation of regulations and other acts regulating issues related to the granting of state aid as well as in their procedure making; keeping a record of state aid; promoting and encouraging the improvement of the state aid control system; control of the execution of the measures imposed; preparation of expert bases for drafting of draft laws and bylaws in the field of state aid; monitoring of compliance of laws and subordinate regulations both in the field of state aid and those on which potentially it can be granted state aid, with EU standards and regulations; to cooperate with international organizations competent for state aid control; compilation and publication of statistical information on procedures before the Agency and performing other activities in accordance with the law and preparation of the annual report.
2.1. In the Department for Establishing State Aid Compliance deals with: conducting administrative proceedings and solving individual administrative matters in the field of state aid are carried out in the Department for the Determination of State Aid Harmonization; collection, processing and monitoring of data on planned state aid; establishing the compliance of the notified state aid with the State Aid Control Act (previous control), giving opinions on proposed acts (schemes) potentially representing state aid, giving opinions at the request of the state administration body, the competent authority of local self-government and the legal entity that manages and disposes funds from public revenues and state property in accordance with the law in the preparation of regulations and other acts regulating issues related to the granting of state aid as well as in the process of their adoption; keeping a record of state aid; encouraging the improvement of the state aid control system; preparation of expert bases for drafting of draft laws and bylaws in the field of state aid; monitoring of compliance of laws and subordinate regulations both in the field of state aid and those on which potentially it can be granted state aid, with EU standards and regulations; the establishment of cooperation with international organizations responsible for controlling state aid; compilation and publication of statistical information on procedures before the Agency and carrying out other tasks in accordance with the law and preparation of the annual report on the granting of state aid.
2.2. The Department for Immediate Control shall carry out the following tasks related to: initiation of a test procedure related to potential State aid, control of compliance of assigned state aid and the use made of state aid with the State Aid Control Act (subsequent control); handling in cases of direct control of use of state aid granted, collection of data on use and effects of state aid granted; monitoring, realization and effects of state aid granted; prepare proposals in the part of the order for the recovery of illegal and non-harmonized state aid; filing a request for initiating misdemeanor proceedings before the competent court and / or misdemeanor orders; control of the execution of the measures imposed.
3. The DEPARTMENT for GENERAL AFFAIRS AND FINANCE is responsible for the following activities: preparation and consolidation of programs, work plans and reports on the work of the Agency; preparation of individual acts on the exercise of rights from employment relations of employees; co-operation with the Human Resources Department in the part of recruitment of staff, professional development and management of the personnel information system; making a proposal for the staffing plan; development of human resources; monitoring activities related to human resources education; conducting administrative proceedings on requests for free access to information; preparation of acts for calculation of earnings, benefits and other employee benefits; preparation and conclusion of contracts with natural and legal persons; conducting personal records; electronic business; keeping basic and ancillary records and aligning with the State Treasury; making a proposal for a financial plan; preparation of the draft budget; the timely and intentional use of resources foreseen by the budget and the financial plan; accounting; making of periodic calculations and final accounts; making financial statements and submitting to the State Treasury; cash management; bookkeeping tasks; verification of the accuracy and completeness of the state money payments; office and auxiliary tasks, reception, sending, sorting, scheduling, recording, storing and archiving of acts and objects and other tasks in accordance with the regulations.
